Woman’s Right to Academic Continuity Amid Pregnancy & Motherhood
Judgment dated 18.6.2026 of the Madurai Bench of the Madras High Court in Writ Petition (MD) No.14351 of 2026 of R. Sangeetha Vs. The Registrar, The Tamil Nadu Dr. Ambedkar Law University and othersThe petitioner had successfully completed theory papers of LL.M. but she could not submit the dissertation
A woman LL.M. student, undergoing pregnancy and thereafter caring for a newborn child cannot be placed on the same footing as an ordinary student for the purpose of strict application of academic timelines.
University Grants Commission communication dated 14.12.2021 recognises the need to extend maternity and child-care benefits to women students and calls upon Higher Educational Institutions to frame appropriate norms granting relaxations and exemptions, including extension of timelines wherever necessary. Though the said communication may not, by itself, create an enforceable statutory right in every case, it reflects an important public policy that educational opportunities should not be denied to women merely on account of pregnancy and motherhood.
