Section 29A does not provide extension of mandate of Arbitrator after the award is passed
DIAC appointed the Arbitrator. By the order dated 12.3.2024, the mandate of Arbitrator was extended by nine months.
The Arbitrator reserved the dispute for award on 13.5.2024 and no objection of the parties was recorded for extension of mandate till 1.9.2024.
By the order dated 6.9.2024, the High Court extended the mandate till 1.11.2024.
The Award was delivered o n 4.11.2024 and copies were delivered on 9.11.2025 to the parties.
The Single Bench dismissed section 29A(5) petition of the appellant and allowed section 34 petition of the respondent on the ground that the arbitral award is non-est and invalid, for the findings extensively reproduced in paras 7 and 8 of the DB judgment.
In that context, in para 12 as reproduced in the post, it was observed that Section 29A does not contain any provision to extend mandate of Arbitrator after the award is passed unless extension application is filed prior thereto and award is passed during its pendency.
