Section 17 RERA Act – Formation of Society and Unsold Units

In the complex, only four commercial units were sold and remaining unsold units belonging to the promoter are given on lease.  Goa Cooperative Societies Act provide for formation of society consisting of at least five such persons.

HELD that the promoter as an owner of the unsold units can be included as a member with other four allottees to meet the minimum requirement of five members.

Judgment dated  2.7.2026 of MahaREAT in Appeal NO.G-24 of 2022 of M/s Umiya Holdings Pvt Ltd and another   Vs.   Anman Bankley and othes with connected appeals.
