Bombay HC – Tender Bid Evaluation is a continuous process culminating in the work order.

we are inclined to agree with the submission of Shri Chetan Kapadia, learned Senior Advocate for CIDCO that “bid evaluation” is a continuous long drawn process and can only be completed after issuance of the allotment letter in favour of the lowest bidder. The term “bid evaluation” cannot be interpreted to mean that the tendering authority i.e. CIDCO is injuncted from raising bid document requirements after a specific date/stage. The evaluation of the technical bid and financial bid are only parts of the overall “bid evaluation”.

Bombay HC – Tender Bid Evaluation is a continuous process culminating in the allotment letter / work order in favour of the successful bidder.

Bombay HC – Technical and Financial Bids Evaluation are only stages within the larger continuum, they do not freeze the authority and powers of the CIDCO to verify or enforce tender requirements including security clearance for foreign JV partner.

Therefore, “bid evaluation” cannot be interpreted so narrowly as to injunct CIDCO from insisting on compliance with bid‑document requirements after a particular date or stage, so long as this remains part of the same procurement process
