Bombay HC – Rights of third Party purchasers of earlier developer against society
Whether the third party – flat purchasers from erstwhile developer of the society can assert or enforce any right, title and interest in the Society’s property or its redevelopment project through a new developer.
The appellants are the third party flat purchasers in the redevelopment project of respondent no.2 Society through respondent no.2 erstwhile developer.
The appellants applied for interim injunction from demolition or construction on the suit property and/or changing the building plan without express consent of the appellants.
HELD that the third party purchasers cannot assert or enforce rights against the Society post termination of developer’s rights.
Third party purchasers have no enforceable rights against the Society or its new developer once the original development agreement is terminated.
