SC – Legal Aid Must Be Timely, Accountable & Digital
Order dated 16.4.2026 of the Supreme Court in Criminal Appeal No. of 2026 in the case of Shankar Mahto Vs. State of Bihar
Legal Aid to Convicts – Legal Services Authority – Comprehensive SoP for Translation and Transmission of Records for filing legal aid appeal and special leave petitions (SLPS) 2025 to minimize delays in legal aid process.
Clause 5 of the SOP deals with the mandatory Timelines and Responsibilities with outlines of key stages, responsible authorities and actions.
Clause 7 is very important and salutary for Digital Coordination.
SOP also provides for coordination with Jail authorities through VC Meetings in its various clauses of Clause 9 of the SOP.
Clause 13 provides for delay explanation to ensure meaningful implementation of the approved SoP.
The aspect of monitoring and accountability as delineated in paragraph 8 of the SOP ensures that there is effective monitoring and ‘keeping tabs’ on the functioning and processes to be undertaken by the Legal Services Committees of the respective High Courts. Let the necessary constitution of the committee be carried out at the earliest. The Standing Committee/Administrative Committee, may appoint the members either by itself or after consulting the Full Court, as may be warranted. The Member Secretary of HCLSC shall be an ex-officio member. In so far as the constitution of the committee for this Court is concerned, the Member Secretary, SCLSC is directed to bring this order to the notice of the learned Executive Chairman, SCLSC and solicit orders thereon as may be deemed suitable by such authority.
