SC Landmark & Eye Opener Judgment on Lift Maintenance
Judgment dated 29.7.2026 of the Supreme Court in Civil Appeal No.4081 of 2014 of M/s. Otis Elevator Co. (India) Ltd Vs. Rashmi Handa and others with connected civil appeal.
Lift Malfunctioning – Contract of Carriage between Carrier & Passenger
On 24.5.2002, there was Maintenance and Repair Contract with OTIS for the upkeep of the lift.
On 20.3.2003, during the descent, the lift carrying 13 occupants including the deceased abruptly stopped between 6th and 7th floors of the complex.
The staff opened the lift door manually on 7th floor, switched off the main supply from 11th floor and started rescuing the stranded occupants one by one. When the deceased being rescued was half inside and half outside the lift cabin, the lift suddenly moved downward for 5-7 seconds, crushing his neck and causing his death.
The widow and two children of the deceased filed consumer complaint for compensation of Rs.1.89 crores against OTIS and others.
