SC Enhances Compensation for Parents of 14-year-old Accident Victim
The Tribunal granted insurance compensation of Rs.1,29,500/- to the appellants for the accidental death of their 14-year old son.
The High Court enhanced it to Rs.4,70,000/-.
HELD that the monthly notional income at Rs.5,400/- per month can be adopted as per the Minimum Wages Act, 1948, for Class B City and 40% increase has to be adopted for future prospects.
The child had died after a day and hence, the parents would be entitled to some compensation for the pain and suffering of the child on his death, which inure to the benefit of the legal heirs. The Supreme Court enhanced the total compensation to Rs.8,65,000/-.
