Pune Court – Maintenance Not Charity, it is a Legal Right tied to the means and lifestyle of husband working in MNC

Salutary and important order on enhancement of maintenance under Section 20 read with Section 25 of the PWDV Act and also payment of maintenance of jointly owned four flats.

Initially, the maintenance of Rs.30,000/- per month was granted to the wife and major daughter considering that an amount of Rs.1,48,000/- rent from four rented flats jointly owned by the couple was received by the wife.

Thereafter, the respondent-husband working in MNC, started interfering to reduce the rental income of the wife by sending legal notices to the tenants for vacating the flat and/or to deposit partial rent to him being the co-owner.

Moreover, the wife was compelled to incur maintenance of four jointly owned properties. Similarly, the respondent was not paying the educational expenses of major daughter.

All this has resulted in domestic violence of financial and emotional abuse of the wife and the daughter.
