Interesting case and the facts  – The Petitioner had completed three years integrated course of B.Com.  He had applied for three years LL.B. course in 2019 and had given all the certificates showing marks of B.Com.  He had completed 5 out of 6 semesters.   The result of 5th semester was withheld on the ground that his admission from OBC category was not legal since he had less than 42% marks in B.Com.

HELD that the admission form did not specify that average of 3 years of B.Com should be given, the petitioner had given all the certificates of marks in B.Com at the time of admission, there was no mis-declaration, no action was taken for more than 2 years knowing the marks of the petitioner, the petitioner had obtained goods in 4 semesters of LL.B. course, the objection to the eligibility for admission was taken at the fag end of the course, there was no allegation of concealment and admission was confirmed on verification of mark sheets by both the respondents.
