Identity Theft – Misuse of Aadhaar & Pan – Impersonation
Regulations 28 and 29 of the Aadhaar (Enrolment and Update) Regulation, 2016.
RBI Master Direction – Chapter VI deals with the customer identification procedure. Para 16 provides that regulated entity shall obtain following documents for account-based relationship. Proviso to para 16 provides that the bank shall carry out authentication of customer’s aadhar number by using E-KYC authentication provided by UDAI. It also requires offline verification, digital signature, verification through digital KYC, etc.
Directions to take prompt action when such fraud surfaces and pray that the common citizen of this nation does not suffer the mental agony like the petitioner. Cost of Rs.10,000/- imposed on respondent nos.1, 2, 5, 6 and 7 for dereliction in their duty and not initiating criminal proceedings till today on the fraud being discovered and for non-appearance of Respondent Nos.5 and 7.
