HDFC Employment Contracts Jurisdiction in Mumbai Courts – Suit against termination filed in Nagpur Court – Maintainability

The appointment letter of the plaintiff provided for the exclusive jurisdiction of the Courts at Mumbai.

However, the plaintiff filed suit challenging termination of her service and for damages, in Nagpur court. The application of the Bank under Order VII Rule 10 for rejection of plaint for want of territorial jurisdiction, was rejected on 5.4.2018.  This was confirmed by the High Court vide its judgment dated 16.8.2018.  The review application was also dismissed.  These orders have become final.

Thereafter, in 2025 the Supreme Court in another case of 2025 SCC OnLine SC 752 of the same Bank upheld the same clause of jurisdiction of Courts at Mumbai.

In view of this, the Bank again filed application order under Order VII Rule 10 of the CPC.  However, it was rejected by the order dated 26.8.2025 on the ground of res judicata.

Judgment dated 6.4.2026 of the High Court of Bombay, Bench at Nagpur, in Civil Revision Application No.4 of 2026 of HDFC Bank Limited and others   Vs.  Mrs. Archana Sachin Dongre
