From Goa to Interpol – Aadhar Card Trail of Foreign National Faces legal Heat

Police Inspector, PS, Anjuna, Goa, has filed this application for disclosure of demographic information of Respondent No.3 an Israeli National in Goa Jail submitted by him at the time of enrolment of Aadhaar card and the agency of such enrolment.
This is in connection with the NDPS offences registered against the Respondent No.3. During investigation, it was found that the said Israeli National, was without staying in India / Goa without any valid passport or visa but issued Aadhaar card. This Aadhaar card was handed over by one of the witnesses to the police.
Thereafter, the crime under the Foreigners Order 1948 and the Foreigners Act 1946 was registered.
The respondent no.1, however, rejected the police request for information and documents of enrolment in view of bar under Section 33 (1) of Aadhaar (Targeted Delivery of Financial and Other Subsidies Benefits and Services) Act, 2016.
HELD that since the respondent no.3 did not possess valid passport, visa or any travel documents and involved in the crimes but found in possession of Aadhaar Card issued on 11.8.2021, the police has sought information to enable investigation on the issuance of said Aadhaar Card.
Disclosure of the information by allowing copies of Form 1 for POI, POA and POB would, therefore, not result in disclosing any personal document or personal information of respondent no.3 which he seek protection of.
