Freezing / Attachment of Accounts Accused – Section 102 of Cr PC & Section 18A of the Prevention of Corruption Act

Charge-sheet was filed on 13.5.2024 against four persons including the respondent – father of the main accused.

HELD that Section 102 Cr PC being distinct from the powers and procedures as detailed under Section 18A of PC would apply to the case.  However, since the investigation has been completed and final report was presented, the freezing of the accounts of which fixed deposits are part, may or may not be required.
