Accident Compensation – Variance in the Vehicle Registration Number

The accident took place on 241.2009 and the accused was arreste on 20.2.2009. There is no reference of any vehicle in the FIR.  However, in the charge-sheet, the vehicle number was given as MP-09 FA 0292.

The Motor Accident Claims Tribunal dismissed the claim petition of the parents of the accident victim for variance in the registration number of the vehicle.  The Tribunal had refused to consider the charge-sheet on the ground that the vehicle was not attached in connection with the accident.

HELD that the reasoning of the Tribunal is improper.  In a vehicular accident there is no need to attach the vehicle. Moreover, the reasoning that the statements recorded by the police are not part of the record is not correct because this is not a criminal trial but summary trial.
