Refund of Stamp Duty with Interest
In 2013, the Development Agreement with the owners of the property namely; Balawadkar was registered and stamp duty of Rs.70,12,500/- was paid.
Subsequently, the said agreement was cancelled and the owners had returned the consideration to the petitioner.
On 18.2.2014 the petitioner and the owners registered the cancellation deed. On 7.4.2014, the petitioner applied for refund of the stamp duty.
The said refund application was rejected since it is not a conveyance covered by the proviso to section 48(2i) of the Bombay Stamp Act, 1958.
