Compassionate appointment of third born after cut-off date

Compassionate Appointment of the respondent – 3rd child born after cut-off date 31.12.2001.  

The police constable – father of the respondent – had two wives while in police service.   The respondent was born on 9.1.2003 from the second wife.

The police constable died on 23.4.2010. 

On attaining majority on 9.1.2021, the respondent applied for compassionate appointment.

The Commissioner of Police rejected the said application on the ground that the respondent was the third child born after cut-off date of 31.12.2001.

Relying on the Full Bench decision dated 27.7.2023 in W.P.No.9284 of 2022 in Sunita Dinesh Gaikwad case and Clause (e) the Government Resolution dated 21.9.2017, it was held that third child born after 31.12.2001, is not entitled or is not eligible for appointment on compassionate ground.
