Admission – Dental course – Online Uploading of documents – Lack of connectivity to the portal

On 24.10.2024 the petitioner-student was given provisional admission to the M.D.S. against the stray vacancy by the Medical Counselling Committee. On 24.10.2024 itself, all the documents were verified by the Dental College, undertakings and affidavits were given and entire fees was paid. On 24.10.2024, the petitioner joined the College and started pursuing MDS course.
As per the Circular dated 16.10.2024 of the Dental Council of India, the Dental College was required to upload all the documents and confirm admission of the student by midnight of 25.10.2024. However, the said documents could not be uploaded due to connectivity problem and heavy rain in the rural area of the Dental College. On 26.10.2024, the College informed the Dental Council that the student was admitted but documents could not be uploaded due to connectivity issue.
On 21.11.2024, the Dental College again informed the Council about the difficulty in uploading documents. However, on 2.12.2024, the Council informed the College that the portal was closed in the midnight of 25.10.2024 and to discharge the student. This was again reiterated vide letter dated 18.12.2024.
HELD that having perused the documents and the events, the student is not at fault at all. The Dental College has been able to explain the genuine difficulty in uploading the documents before midnight of 25.10.2024 due to lack of connectivity as a result of heavy rainfall in its rural area. The screenshot amply supports the stand that due to continued lack of connectivity the documents could not be uploaded. Therefore, it cannot be said that either the admission of the student was not on merit and that the College defaulted in compliance of the Circular dated 16.10.2024.
Merely because the documents of student admission could not be uploaded on the portal due to genuine difficulty of connectivity, it ought not to jeopardize the academic career of the student.
