Caste Scrutiny Committee – Costs imposed by Bombay High Court

The petitioner belongs to “Mana” Scheduled Tribe.  The petitioner is preparing for NEET examination and needed caste validity certificate. The caste certificate was sent to the Respondent No.1 Committee for scrutiny.

The petitioner had produced as many as 90 documents including 16 caste validity certificates of blood relatives from paternal side including of his father and real sister were granted caste validity certificates.  He has produced documents of 1914, 1916 and 1943 of his forefathers belonging to ‘Mana” Scheduled Tribe.

The old entries of forefathers pertaining to pre-independence period are extracted in para 4 of the judgment.   The genealogy and the details of 16 caste validity certificates also extracted in the judgment.

However, the Committee had invalidated the tribe claim.

HELD  that even if the names of four persons of caste validity certificates are not matching with the genealogy, that still leaves us with 11 people who are genealogically related who are blood relatives and granted caste validity certificates.
