Consumer Complaint against Legal Heirs of late Developer -Maintainability

 judgment dated 17.7.2026 of the National Consumer Disputes Redressal Commission, New Delhi, in Consumer Complaint No.NC/CC/98/2019 of Anil Kisan Shelke and another   Vs.  Shubhangi Sanjeev Shelke and two others with connected matter

The owner and the developer had undertaken redevelopment of the building at Pune.  He was uncle of the complainants and had given finance for construction.  The owner had executed the agreement to sell dated 14.10.2014 for the flat with one parking space for Rs.80 lakhs and the possession was to be given before 30.8.2015.  The complainants paid Rs.79,52,680/- to the owner.

The original owner expired in April 2015 and his legal heirs had continued with the construction.  However, the legal heirs – opposite party.  They had revised the sanctioned building plans without consent of the flats developers.   However, instead of completing the construction, the legal heirs filed civil suit for cancellation of the agreement.

In this background, the complainants filed consumer complaint in 2019.
