Section 18 of MC Societies Act – Bifurcation of Society
The petitioner is the common society for two buildings for the last 52 years and appointed developer for redevelopment. However, the developer did not make any progress. The proposal for separate society of respondent no.4 was proposed for Veena building. However, the said petitioner rejected the said proposal by the petitioner society and also terminated the Developer. On 5.9.2024, new Developer was appointed.
On 6.8.2024, the respondent no.4 had filed the proposal for bifurcation of the petitioner society. The Deputy Registrar rejected the said proposal.
HELD that the time line of submitting bifurcation proposal of the society leave no manner of doubt that it was mooted and submitted solely for creating hurdles in redevelopment process through new developer.
