Compensation for Defective Business Class Seat in Flight
Order dated 12.6.2026 of the NCDRC in First Appeal NO.NC/FA/152/2024 of Justice Chandra (retired) Vs. Air India Limited with connected matters.
The complainant has medical conditions including cervical spondylosis and sciatica. The air tickets of the complainant and his wife were in the business class for air journey Delhi to Sans Francisco and back.
In the return journey, the complainant was allotted defective and non-reclining seat in the business class. It was not changed despite repeated requests.
The complainant suffered severe discomfort and deteriorated requiring medical treatment including with an orthopaedic surgeon, medication, best rest and physiotherapy.
The complaint for compensation of Rs.1,95,00,000/- with other reliefs was filed. However, the State Consumer Commission found deficiency in service but partly allowed the complaint and granted compensation of Rs.20 lakhs.
The NCDRC confirmed the judgment and dismissed both the appeals.
