Courts will not extend Article 21 Shelter Rights to override clear statutory exclusions under the environmental and forest laws.

The petitioners are encroachers having illegal hutments on the government  public and therefore, no relief cannot be granted.  Doing so would tantamount to a premium on illegality which the law would never permit.
