Order Refusing Registration under FCRA 2010 Must Give Reasons

the online application of the petitioner dated 30th October 2024 seeking grant of registration under the Foreign Contribution (Regulation) Act, 2010 (for short “FCRA, 2010”) has been refused under Section 12, sub-sections (4) (vi) of the FCRA Act, 2010

it is clear that it is mandatory for the Central Government to record in its order the reasons and furnish a copy thereof to the petitioner if the Central Government refuses the grant of certificate or does not give prior permission. Although the proviso to sub-section (5) of Section 12 provides that the Central Government may not communicate the reasons for refusal for grant of certificate or for not giving prior permission to the applicant under this section in cases where there is no obligation to give any information or documents or records or papers under the Right to Information Act, 2005, there is nothing on record to show that the said proviso is applicable to the facts of the present case.
