Imperative Need for Sports Law Regulations

 

Mr. Rajiv Tuli – Thanks for sharing comprehensive and well researched analysis article on Sports and imperative need for substantial Sports Law regulations for the “full-fledged enterprise of Sports” in India.

Few points for consideration –

There is no single comprehensive law governing Sports.  It is mainly governed by the Contract Act.   After framing National or State Policy on Sports and reviewed from time to time, the Central and the State Governments have left sports at the mercy of few regulatory bodies and mainly to the associations.   Their policies and laws have remained static and stagnant, although the sport has now become lucrative industry with huge investment from all over the world. 

Recently, the Hon’ble Judge of the Supreme Court had advocated for specialized University for sports to focus on research, legal assistance and addressing issues of sport industry both for the benefit of players and sports ecosystem in India.

There is, therefore, imperative need for evolution of sports adjudication and arbitration as a viable solution.  

There is also need to provide for legal frame-work to Third Party Funding in sports arbitration litigation on the lines of Singapore, UK and Hong Kong, in the welfare and interests of players.
