Uber Cab – Service Provider – Timely services – Delay in arrival – Flight missed – deficiency in service
The complainant – doctor booked the Uber taxi for International Airport, New Delhi. However, the driver did not turn up and the complainant had to go by private taxi but could not take his flight for Indore due to the negligence of Uber. The complainant had to take air ticket for double price. He could not take the function at Indore properly due to the fault of Uber Taxi. The District Forum allowed the complaint and directed Uber to refund Rs.24,100/- for second air ticket, Rs.30,000/- for mental agony and litigation charges.
HELD, Uber as service provider is liable for the actions and inactions of the driver – partner. Although Uber is aggregator – platform for connecting riders and independent driver – partners, it is equally true that that such transportation and platform assumes an obligation to ensure that the services offered through its platform are delivered as promised and in a timely manner. The inability of Uber to deliver on this responsibility constitutes a clear deficiency in service and must be held accountable for the resultant harm caused to the respondent.
