Supreme Court Expands Framework for Child Injury and Disability Compensation

In the accident, minor student of 14-years suffered 77.1% permanent disability on account of the injuries in the motor accident of 19.4.2022.

 

The Tribunal awarded compensation at Rs.1,73,000/-.  The High Court enhanced the same to Rs.4,12,383/-.

Principles for determination of compensation for the injuries sustained by the children resulting in permanent disability.

Following the decision dated 11.2.2025 in Sona (minor) vs. Manual C.M. (Civil Appeal No.2316 of 2025), as a guiding precedent,

The High Court, while granting medical expenses on actual bills, overlooked that the appellant would have incurred misc. amounts on medical treatment during his 22-days hospital stay, in the nature of out-of-pocket expenses. Furthermore the appellant would be required to spent on medical treatment in future also. 

Attendant charges of Rs.40,000/- and under the head of loss of marriage prospects, Rs.3 lakhs deserve to be awarded.

Rs.40,000 for special diet and transportation.

Rs.3 lakhs for pain and suffering.

As a result, the Supreme Court enhanced the compensation to Rs.15,13,337/-.
