Stamping of Instrument in Arbitration Proceedings

It was wrongful insistence of the stamp authorities to insist on production of original instrument. Section 32(2) explicitly provides that for adjudication the Collector may require a true coy or an extract be furnished to examine and computer the amount of stamp duty.
The High Court has advised the stamp authorities to take note this judgment and deal with future requests for stamping sent by the Arbitrator in accordance with law. The Registry shall send a copy of this Judgment to the Inspector General of Registration and Controller of Stamps for appropriate sensitisation t officials involved in adjudication of stamp duty.
