Seniority of Secondary School Teachers – Category C of Schedule F of the MEPS Rules 1981

The petitioner joined the school on 15.11.1990 with SSC and D.Ed. (2 years) qualifications.  While in service, he passed B.A in 1992 and B.Ed. in 1998.  However, he was given seniority in Category C on 3.6.1998.   The contention of the petitioner that seniority should have been given on passing B.A. on 18.7.1992.

Following the earlier decision in Writ Petition No.1221 of 2022 decided on 11.3.2023 in Sahakar Vidya Prasarak Mandal case, it was held that the petitioner is entitled to the seniority as on 18.7.1992 on passing B.A. this Court has held that if a teacher has the qualification of 2 years D.Ed. course within the meaning of Note-2, upon acquisition of B.A. qualification, he would straightaway catapult to the third category in Category-C from Category-F. This Court held that if such interpretation is not given to Note-2, the provisions of Note-2 would be rendered otiose.

In the said case, the Court has interpreted Schedule F as it stood prior to amendment by the Notification dated 24.3.2023 and therefore, the interpretation in Sahakari Vidya Prasarak Mandal case would apply with full force to the present case as well.
