Senior Citizen – removal from her own flat – High Court ordered restoration

The respondent Senior Citizen is the joint owner of the flat with her husband who passed away in January 2022.  The respondent is the step son.  In February 2022, the respondent was removed from the flat.   She is severely ill and staying with her sister who herself is 84 years old.

HELD that during the life time of the parents, the children cannot assert any legal rights to their property and claim ownership or possession. Therefore, the direction of the Senior Citizens Tribunal for restoration of the flat to the respondent was upheld.
