Section 133 of Cr PC – Stone crushing plants near Atul Setu
The petitioners are the owners and occupants of various lands at village Jasai in Taluka Uran of District Raigad and operating stone crushing plants with the consent of Pollution Board and mineral licences. These plants are near Atal Setu.
On 28.6.2024, the orders under Section 133 of Cr PC to stop the crushing plants till the reports of the Committee on threat to the Atal Setu are submitted.
Atul Setu Trans Harbour Link is one of the premier infrastructure projects and crucial link for entry and exit from Mumbai City.
HELD that on consideration of the impugned orders it is seen that the Magistrate has ordered is “completion of process” under Section 133 of the Code. It is nothing but a pro tem measure till the IIT conducts inspection and submits report on whether the petitioners’ plants are really causing any damage to Atal Setu or endangering lives of passengers travelling therein.
