Section 11 application for appointment of Arbitrator to resolve disputes arising out of the partnership deed dated 1.4.1998 of Inter Globe Services.

On 2.5.2022, the suit no.852 of 2016 filed by the petitioner Aruna – daughter Mulchand Shah & partner – was settled by consent terms. The subject matter of the suit was between the petitioner, mother and her brothers as to who would be entitled to Mulchand’s share from Inter Globe.

IA 4903 of 2022 was filed for declaration that the term “mutually agreed amount” in the consent terms is Rs.11.11 crores payable to the petitioner and also injunction against arbitration.

The dispute is about accounts of the firm and the value of the goodwill of Inter Globe and share in such goodwill.  The Partnership Deed provides for arbitration agreement.  The dispute relates to the amount payable by Inter Globe to Aruna.
