Admission to MBBS / BDS – Sports Quota – Process and Criteria changed after its commencement

On 31.7.2023, the Sport Policy of 2023 was brought into force.   Rule 4.2 of the said policy specifical provided that a sub-junior tournament would be ineligible while grading sporting achievement.  The policy did not indicate the classes / year for assessing the competing merit of candidates under sports quota.

On 9.8.2024, the prospectus for MBBS / BDS course during session – 2024 was released by the University and it was provided that the credit for sports achievements of Classes XI and XII would only be given.

On 10.8.2024, revised prospectus was issued without any change in the sports quota credit.

On 16.8.2024, an email was sent to the candidates to submit their sports certificates of achievements during any class / year including Classes IX and X.

The Supreme Court found that the Roller-Skating Coach and father of the respondent no.4 made an undated representation that the sports achievements in Classes IX and X should also be included for admission to MBBS / BDS Session – 2024, without disclosing that this would benefit her daughter respondent no.4 in the said admission.

In view of change in the policy, the respondent no.4 ranked no.1 in the merit list of 23.8.2024 from the sports quota.

State and its instrumentalities have a duty and responsibility to act fairly and reasonably in terms of the mandate of Article 14 of the Constitution and that any decision taken by the State must be reasoned and not arbitrary. It was further observed that when a thing is done in a post-haste manner, malafides would be presumed as anything done with undue haste can be termed arbitrary and would not be condonable in law.

The State of Punjab adopted “elastic” approach to sports quota admission to MBBS / BDS course, altering criteria after admission process had commenced.  Any modification mid-admission process is imperssible.
