RTI – Disclosure of Marks at the recruitment – Transparency
The impugned orders refusing to disclose marks secured by the petitioner – candidate and other candidates (1 to 363) in the written / screening test, Marathi / English typing test and interview for recruitment to the post of Junior Clerk in Pune District Court are illegal.
Section 8(1)(j) and Section 11 of the Right to Information Act and Rule 13€ of the Maharashtra District Courts Right to Information (Revised Rules), 2009
Disclosure of marks in the recruitment does not constitute “exempted” information and did not affect the “confidentiality” of the examination. In fact, the disclosure of such marks promotes transparency in the matter of public recruitment. Withholding such information of recruitment unnecessarily allows doubts, however unreasonable, to linger, which is not very healthy in promoting transparency and accountability in the working of the public authorities and public recruitment process.
Regarding RTI, it is repeatedly asserted that sunlight is the best dis-infectant.
