Redevelopment of 11.20 acres land in Sion Koliwada, Mumbai by MHADA through Tender

By the Government Resolution dated 14.2.2024, the Government had appointed MHADA as the Special Planning Authority to re-develop the land of 11.20 acres land known as Guru Teg Bahadur Nagar in Sion Koliwada, Mumbai, after demolition of 25 buildings (between 2019 and 2022) by appointing a Construction and Development Agency through tender process.

The petitioners Developers have challenged the said decision and e-tender issued by the MHADA for re-development as per Regulation 33(9) of the Development Control and Promotion Regulations for Greater Mumbai 2034.

It was observed that 14 out of 25 societies and 716 out of 1200 residents have supported the decision of MHADA appointment.  Moreover, 692 displaced families are waiting rehabilitation since 2019.

The claim of the Petitioners for the rights in the land and redevelopment prior to the formation of the cooperative societies were not valid.

The payments of Rs.9.35 crores by the Developers to the residents did not confer enforceable rights against MHADA.
