Power Distribution Licensee – Imposition of Reliability Charge
Respondent no.1 is the steel industry and exporting its end products. It is a continuous process industry on express feeder and a bulk consumer. The appellant did not subject them to load-shedding.
By the Tariff order dated 20.10.2006, the Maharashtra Electricity Regulatory Commission imposed additional supply charges for uninterrupted power supply to the bulk consumers like respondent no.1.
In the next Tariff Order dated 20.6.2008, the said charges were discontinued and directed the appellant to refund said charges collected during 2006-2007 and 2007-2008.
By the order dated 15.6.2009 and on the petition of the appellant, the Commission imposed reliability charge from 16.6.2009 to 31.3.2010 on account of Zero Load Shedding (ZLS) in Pen Circle.
The said order was set-aside by the Electricity Appellate Tribunal on the ground that neither Section 62(3) of 2013 Act nor the Rules and the Regulations support such reliability charge.
