Passport – Minor daughter – Objection of the father on account of matrimonial disputes
The marriage of the parents of minor petitioner was solemnized on 1.11.2006. The petitioner was born on 1.11.2008. There is a marital dispute between the parents of the minor petitioner. There are pending litigations between the parents in the courts.
The petitioner is a bright student and secured above 90% marks in X standard examination. was nominated from Kendriya Vidyalaya Schools for the Saura Science High School Programme in Japan.
On 28.10.2024, the petitioner had applied for the passport. However, it was refused in view of objection taken by the father.
Declaration in Annexure “C” when one parent has not given consent to the passport for minor.
HELD that the petitioner’s right to travel abroad cannot be scuttled or taken away by denying passport for the reason that the father has disputes with the mother and has not given consent to the passport application of minor.
