Contempt of Courts – Punishment of suspension of Doctor’s licence

Contempt of Courts Act, 1971 – Whether the Doctor’s licence to practice medicine – Interesting case and facts unfolded in the judgment dated 28.7.2023 of the Supreme Court

 

The Appellant made unauthorised construction of a structure in deviation of the plans sanctioned by Siliguri Municipal Corporation.

After two rounds of litigations, fresh order dated 25.6.2019 for demolition of unauthorised construction.

Writ Petition No.349 of 2019 filed by the petitioner was  disposed of by the High Court of Calcutta for filing appeal before the Principal Secretary, who, by the orders dated 8.1.2020 and 28.7.2020, directed the Corporation to aid the appellant for self-demolition and on his failure, to take steps for demolition.

Thereafter, the respondent no.1 filed Contempt Petition in which the licence to practice medicine of the appellant was suspended.

HELD that the punishment provided by Section 12(1) of the Act is simple imprisonment not exceeding six months or a fine not exceeding Rs.2,000/-. It was found that suspension of licence of lawyer, doctor, chartered accountant, etc; found guilty of contempt of court cannot be resorted.
