In 2008, the petitioner was initially appointed as Assistant Teacher on un-aided post.
In 2017, the petitioner was transferred from fully unaided post to the vacant fully aided post of Assistant Teacher in the respondent no.4 junior college, as per Section 41 of the MEPS Rules, 1981.
The Deputy Director of Education granted approval but only for 20% grant-in-aid from 1.7.2017. On 23.8.2023, the impugned order revising the approval was issued holding that the petitioner is entitled with rise of 20% grant in aid salary
HELD that the clause 3(5)(b) of the Government Resolution dated 28.6.2016 has put constrains of giving an undertaking to accept the partial salary even though the transfer of employee in private schools from unaided post to aided post is permitted.
