Bombay HC Quashes DPC Order, Restores 2024 Seniority list for promotion to the post of Superintending Engineer in Pune Municipal Corporation.

The petitioners – graduate civil engineers – are working as Executive Engineers in the Pune Municipal Corporation.  The petitioners belong to the open category.  Initially, they were appointed in the pay scale of Sub-Engineer

The respondent nos.1 to 4 joined PMC in 1996, 1997 and 1998, as junior Engineers.  They belong to Nomadic Tribe category. They were appointed as Junior Engineers from Diploma category.

In the final seniority list dated 11.9.2024, the peptitioner nos.1 to 4 were at serials no.21, 24, 26 and 14, whereas, the respondent nos.4 to 6 were at serial nos.28, 29 and 27, respectively.

However, in the meeting of DPC held on 2.9.2025, it was decided that the promotion to the post of Superintending Engineer is to be determined on the basis of seniority as on 25.5.2004 and consequently, the respondent nos.3 to 6 were considered for the said promotion as against the petitioner nos.1 to 4 on the ground that they being senior as per the date of their joining / length of service.

It is said that this was done to correct the mistakes crept in the final seniority list of 11.9.2024, inasmuch as, the seniority was not considered from 25.5.2004 in the said seniority list.

HELD that the errors cannot be perpetuated by the Department Promotion Committee of PMC under the guise of correction of the final seniority list of 2024 for promotion to the post of Executive Engineer.
