Bombay HC Declines Arbitration Control – Telangana Plant Insurance Dispute

The respondent in its Secunderabad office had given industrial all risks policy to the Applicant for its plant in Telangana and the policy was serviced in Telangana.

On 4.2.2020, the terrace water tank in the plaint had collapsed requiring to switch off the electricity.  This had resulted in loss and damage to the property and inventory.

The policy does not explicitly set out the set or the venue.

HELD that the silence of the arbitration agreement on venue or seat, the High Court of Bombay does not have jurisdiction only because the head office of the Respondent is in Mumbai.
