Bank Account Opening – Aadhar Card is not mandatory
In January 2018 the petitioner applied to the Respondent Bank for opening bank account. The Bank informed that Aadhar card is mandatory. The petitioner filed the writ petition and also prayed for damages.
On 29.11.2018, the Bank made the statement that in view of the judgment of the Supreme Court in Justice Puttaswamy case, it would open the bank account in the name of the petitioner without insisting for Aadhar Card. Liberty was given to file reply on the prayer for damages. Accordingly, in January 2019, the bank account was opened.
However, the Bank had not filed reply on the prayer for compensation despite order dated 29.11.2018 of the High Court.
The petitioner could not rent the premises in Mumbai from January 2018 to January 2019 for want of bank account. In the meanwhile the Founder Director passed away and survived by his 84 years old wife, daughter and the petitioner. Thus, the petitioner could not gain income by renting the premises.
HELD that there was no justification for not opening the Bank account after 26.9.2018 till it was opened in January 2019. Thus, the petitioner was unable to rent out the premises for three to four months. The compensation of Rs.50,000/- was accordingly paid to the petitioner.
