Section 9 Petitions – Interim Relief – Access to the amenities in Lodha Worli

The petitioners have apartments at Lodha World Towers at Worli. They have agreement with Macrotech to FCAM charges.  They have fully paid all applicable dues of Federation Common Area Maintenance Charges to use amenities of Gymnasium, Club House, Spa, etc.

According to the respondent, the petitioners are in default and to assert its rights, has cut off access to certain common amenities.

In order to purely adjust equities and to balance the competing interests of the parties, the High Court passed order to meet the ends of justice pending completion of arbitration and to provide access to all amenities in all common areas of Lodha Worli to the petitioners on payment of provisional FCAM charges.
