Section 12 of the DV Act – Widow has right to reside in the shared household & matrimonial home

The petitioner with her husband and in laws i.e. brother-in-laws, sister-in-laws and mother-in-law were residing in the shared household.   However, after the death of husband on 14.6.2009, the petitioner is subjected to cruelty and attempted to oust her from the shared household.

 

HELD that the contention that the petitioner owns another property and she has no right to reside in the shared household is not legal.
