Senior Citizens and Parents – Protection and Maintenance – Order directing the son to vacate the flat and pay maintenance of Rs.5000 per month to the parents – Police aid for Implementation.

The petitioners – senior citizens – approached the Tribunal for Maintenance and Welfare of Parents and Senior Citizens against the harassment of their son with a prayer to direct the respondents to vacate the flat and for maintenance.

By the Order dated 6.6.2022, the complaint was allowed.   However, the respondents had refused to comply with the said order. The petitioners filed application on 11.5.2023 for implementation of the order.

Grievance of the petitioners that no action is taken to implement the order on the ground that the respondents have filed appeal and the police are also helping the respondents.

HELD that the police report for not implementing the order was not satisfactory.  Therefore, directed the respondent nos.1 and 2 to hand over flat to the petitioners in ten days and if not handed over, the Police shall act as per para 6 of the Order of the Tribunal.
