Basement godowns converted in Bar Restaurant, liquor shop & gambling den in Pune Cantonment area
Rather strange and unfortunate case as observed by the High Court of Bombay that the Cantonment Board and the PCMC have pleaded almost helplessness or powerless in taking action against admitted illegalities.
Cantonment Board says that PCMC should take action, whereas, PCMC states that the must act to stop unauthorised conversion / user.
The Petitioner – retired Colonel filed complaints against unauthorised conversion and use of godowns in the basement by the Respondent Nos.9 to 12 for Bar Restaurant, Liquor shop, gambling den, etc; in Nirman Arcade. However, no action was taken.
Directions (i) to seal the premises, (ii) prosecute all wrongdoers, (Iii) inquire into the NOCs of some Board Members on their personal letters, (iv) PCMC to inspect the godowns in 15 days and to complete the action against owners / occupiers in three months, (v) the Cantonment Board & PCMC must compliance report in three months with photographs and (vi) the respondent nos.9 to 12 shall pay costs of Rs.1,00,000/- to the petitioner.
