Pay-scales of AICTE if can be given to the teachers and employees of technical schools governed by the provisions of  MEPS Act, 1977 (State Act) & Rules of 1981

State Act of Maharashtra Employees of Private Schools (Conditions of Service) Regulations Act, 1977 and the Rules of 1981 provide for frame work for pay-scale of private schools employees.  The State Government has been issuing Resolutions in respect of pay scales or revised pay scales working in technical schools.  Until 1990, all technical schools were subject to the provisions of MEPS Act.

Central Act of All India Council for Technical Education Act, 1987, for regulating technical education in the country.  

AICTE Regulations 2010 provide for revised pay scales, conditions of service and career advancement scheme for employees in polytechnic institutes.

The reference of difference in opinion of two Division Benches was referred to the Full Bench.

HELD that the strict compliance of Sections 4 & 16 of the MEPS Act and Rule 7 of the MEPS Rules and the amendment to Schedule C is not necessary for making the AICTE pay scales applicable to the employees of technical schools governed by MEPS Act  &  Rules.
