TRAI – New Directives of 8.11.2023 to end harassment of “Unsolicited SMS messages and phone calls” – Now consent of user is mandatory
TRAI – end of unsolicited SMS messages and harassment of receiving phone calls to open bank accounts, investment, real estate, loan, etc – Directive of 8th November, 2023 to seek consent of telephone subscribes
Under the existing system, the consent is obtained and maintained by the entities. However, it is not possible for the Access Providers to check veracity of consent. Similarly, there is no unified system for customers to provide or revoke the consent.
Now, under the Digital Consent Acquisition covered by new Directives of 8.11.2023, TRAI has directed the banks, financial institutions, insurance / trading companies, business entities, real estate companies, etc; to seek user’s consent known as “Digital Consent Acquisition” before sending any messages or making phone calls. A common short code will be used for the consent, purpose, scope, name of entity / brand.
The salutary object is that the users will have choice to give their consent and also to withdraw it subsequently – both are part of the consent acquisition message.
