Kabaddi Player -Cancellation of eligibility certificate granted earlier

Government Resolution of 1.7.2016 for 5% reservation in government and semi-government for the meritorious sports persons.

 In 2016 the petitioner secured “Runner-up” position in Kabaddi in the All India Agriculture Universities Sports & Games Meet.  This was modified by the GR dated 10.10.2017 but the criteria was not changed.

 On 15.3.2019, the petitioner was granted eligibility certificate as per the said GRs for reservation.

 During the period of 2019 to 2022, the petitioner appeared in various competitive examinations.

 By the impugned order dated 3.10.2022, the respondent no.2 cancelled the certificate on the ground that she did not participate in the Akhil Bharatiya Inter-University Sports Competition”.

 HELD that when paragraph 2(B)(vi) refers to “Akhil Bharatiya Inter-University Sports Competition” connotes a broad categorisation of the nature of the sports competition.   It necessarily needs to include an “All India Inter-Agriculture Universities Sports Competition”.  The Deputy  Director of Sports has taken a narrow and pedantic approach of such eligibility criteria, without applying his mind that there are different classes of Universities and the Deputy Director of Sports has purely and mechanically gone on an erroneous reading of the said clause.
