Slum Rehabilitation Scheme in Thane & eviction of Tribals -Sections 33 & 38 of the Slum Act
The petitioners – tribals have questioned the notification of declaring their land as Slum Rehabilitation Area and directing their eviction from the structures occupied by them on the land at Panch Pakhadi in Thane District.
On 17.3.2016, the Slum Rehabilitation Scheme was approved. SRA issued the Letter of Intent for respondent no.6 Developer and on 21.6.2024, the revised LoI was issued.
On 24.9.2024, the Authority passed orders under Sections 33 and 38 of the Slum Act directing the petitioners to hand over possession.
HELD that in the absence of any document showing allotment of land to the ptitioners and in the light of revenue authorities that no portion of the slum land was allotted to any of the petitioners, it is not possible to recognize any special status for them than that of mere occupiers of structures constructed on the government land.
